Security Cameras Aid in the Arrest, Charges Under Criminal Code Explained

SIOUX LOOKOUT – NEWS – In a series of events spanning from October 24 to October 31, 2023, the Sioux Lookout Detachment of the Ontario Provincial Police (OPP) responded to multiple reports concerning suspicious individuals within the municipality. Following a thorough investigation, one individual has been apprehended and charged with several offences under the Criminal Code.

Arrest and Charges

Phillip Kakekagumick, a 34-year-old resident of Sioux Lookout, was arrested and now faces the following charges for his alleged activities during the aforementioned period:

  1. Trespassing at Night – Four Counts (Section 177): This charge is applied when an individual is found without lawful excuse, the proof of which lies on them, in a yard or garden near a dwelling-house during night time. While often considered a minor offence, it could carry a sentence of up to six months in jail.
  2. Break and Enter – Four Counts (Section 348): Individuals are charged under this section if they unlawfully enter a place to commit an indictable offence or when they break out of a place after committing, or intent to commit, an indictable offence. The penalties can be severe, with imprisonment for life in case of a dwelling-house.
  3. Theft Under $5000 – One Count (Section 334(b)): This charge pertains to stealing property valued at $5,000 or less, and it’s a hybrid offence which means it can be treated either as a summary or indictable offence, with maximum imprisonment of 2 years if proceeded indictably.

Kakekagumick has been retained in custody and is slated to appear before the Ontario Court of Justice in Kenora on Thursday, November 2, 2023.
