Adam Capay Faces Sexual Assault with a Weapon Charges

SIOUX LOOKOUT – Adam CAPAY is in custody following an investigation that started in Kejick Bay. CAPAY was recently released from custody in Thunder Bay last month following a decision to stay charges against him in a homicide case.

The Ontario Provincial Police report that on Friday, March 8, 2019, the Sioux Lookout Detachment were contacted by the Lac Seul Police Service (LSPS) to assist with a sexual assault investigation that occurred on or around March 6th, 2019, in Kejick Bay.

The Sioux Lookout OPP Regional Crime Unit has now taken over the investigation and as a result of their investigation have charged 26-year-old Adam CAPAY of Kejick Bay, ON with one count of Sexual Assault with a Weapon, contrary to Section 272 (1) (a) of the Criminal Code. CAPAY is to appear for a bail hearing at the Sioux Lookout Courthouse on March 11, 2019.

The Sexual Assault investigation is ongoing at this time.

Capay’s charges were stayed in February 2019. He was released from custody. The Court ruled that his Charter Rights had been violated. Capay had been held in a plexiglass cell with the lights on twenty-four hours a day, in what is called administrative segregation at the Thunder Bay District Jail following an attack that led to the death of another inmate at the facility. That administrative segregation lasted for 1,647 days.
