FORT FRANCES – On October 3, 2018, at approximately 3:18 PM, members of the Rainy River District Ontario Provincial Police (OPP) received a trespassing call at a Fort Frances institution.
The Fort Frances OPP report in a media statement that an officer attended the location and observed the man, and subsequently asked him to leave the premises.
The investigation revealed that the male had outstanding warrants for his arrest. Upon being informed of the warrants, the man fled the scene on foot. Following a short foot pursuit, the subject was located, becoming combative with officers. He was ultimately arrested.
As a result of the investigation, Ricky KABATAY, 38 years of age, of Stanjikoming First Nation Territory has been charged with:
- Resist Peace Officer contrary to section 129(a) of the Criminal Code,
- Enter Premises when Entry Prohibited contrary to section 2(1)(a)(i) of the Trespass to Property Act,
- Assault contrary to section 266 of the Criminal Code,
- Two counts of Fail to Attend Court contrary to section 145(2)(b) of the Criminal Code,
- Breach of Probation contrary to section 733.1(1) of the Criminal Code.
The accused was held in custody and has a court date on October 9, 2018, at the Fort Frances Ontario Court of Justice in answer to the charges.
