The court found there were no grounds for either the Obstruction of Justice charges or the Breach of Trust charges laid against Chief Lesveque.

The Judge found that the evidence presented by the crown against the Chief was largely circumstantial and the court accepted the explanation by the Chief that his intentions in releasing information on the investigation where for the good of the City of Thunder Bay. Chief Lesveque had relayed information on the investigation to the Thunder Bay Police Services Board Chair and to City Manager Norm Gale.

The Judge also accepted that Chief Lesveque was acting in good faith in dismissing the charges of breach of trust.
